ForeverMotion – Privacy Policy

ForeverMotion (“we”, “us”, or “our”) is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our Progressive Web App (PWA) and website (collectively, the “System”).

Please read this policy carefully. By accessing or using the System, you agree to the collection and use of information in accordance with this Privacy Policy.

1. INFORMATION WE COLLECT

We collect information that you provide directly to us, as well as information collected automatically when you use our System.

A. Information You Provide Directly to Us

  • Account Data: When you register, we collect your email address and password.
  • Upload Data (Your Photos): To provide our service, we collect and process the static images and family photos you upload to the System.
  • Customer Support: If you contact us at hello@myforevermotion.com, we collect the content of your message and any attachments.

B. Information Collected Automatically

  • Usage and Device Data: We collect IP addresses, browser types, operating systems, device information, and details about how you interact with our System.
  • Cookies and Tracking: We use standard cookies and similar tracking technologies to keep you logged in, analyze performance, and understand user behavior.

C. Payment Information

All payments are processed securely by our third-party payment processor, Stripe. We do not store, view, or collect your financial details (such as credit card numbers). Stripe's use of your personal information is governed by their respective Privacy Policy.

2. HOW WE USE YOUR INFORMATION

We use the information we collect for the following business purposes:

  • To Deliver the Service: Running our AI algorithms to transform your static images into dynamic video content.
  • To Manage Your Account: Handling subscriptions, billing, and system authentication.
  • To Improve the System: Troubleshooting bugs, analyzing usage patterns, and optimizing our AI generation pipeline.
  • To Secure Our Platform: Preventing fraudulent activity, abuse, and violations of our Terms of Service.
  • To Communicate With You: Sending transactional emails, billing receipts, and occasional service updates.

3. THE PROCESSING OF YOUR PHOTOS (AI INFERENCE)

Your photos are highly personal, and we treat them with the utmost confidentiality:

  • No Facial Recognition / No Biometric Database: We do not use your photos to create unique biological identifiers, facial templates, or biometric databases. Your photos are processed strictly to apply visual motion and animation.
  • Storage and Deletion: Uploaded images and generated videos are temporarily stored on secure cloud servers to allow you to download them. We automatically purge/delete uploaded source photos and generated outputs from our active production servers after a short retention period (typically 30 days), unless you choose to delete them sooner via your dashboard.
  • No Model Training on Personal Photos: We do not use your personal family photos to train, refine, or improve our public, general-purpose AI models without your explicit, prior consent.

4. HOW WE SHARE YOUR INFORMATION

We do not sell, rent, or lease your personal data or uploaded photos to third parties. We only share your data in the following limited circumstances:

  • Service Providers: We share data with trusted third-party infrastructure providers (such as cloud hosting, GPU server providers, and Stripe for payment processing) who need access to this data to perform services on our behalf.
  • Legal Compliance: We may disclose your information if required to do so by law, court order, or government authority.
  • Business Transfers: If the Company is involved in a merger, acquisition, or sale of assets, your personal data may be transferred.

5. CHILDREN'S PRIVACY (COPPA COMPLIANCE)

Our System is not designed for or directed at children under the age of 13. We do not knowingly collect or solicit personal information from anyone under 13. If we discover that we have inadvertently collected personal data from a child under 13, we will delete that information immediately from our servers.

6. REGULATORY COMPLIANCE AND USER RIGHTS

Depending on where you live, you have specific rights regarding your personal information.

A. For United States Residents (CCPA/CPRA - California and State Laws)

Under the California Consumer Privacy Act (CCPA) and other state privacy laws, US residents have the right to:

B. For European Union & UK Residents (GDPR Compliance)

If you are accessing the System from the EU/EEA or the UK, ForeverMotion is the Data Controller. Your legal basis for processing data is Performance of a Contract (to deliver the AI video service) and Legitimate Interest (security and system optimization).

You have the right to:

  • Access, rectify, or erase your personal data.
  • Restrict or object to our processing of your data.
  • Data portability.
  • Lodge a complaint with a European Data Protection Authority (such as the CNIL in France).

7. DATA SECURITY

We implement industry-standard technical and organizational security measures (including SSL/TLS encryption for data transmission and secure cloud storage) to protect your personal data from unauthorized access, alteration, or disclosure. However, no internet transmission or electronic storage method is 100% secure, and we cannot guarantee absolute security.

8. CHANGES TO THIS PRIVACY POLICY

We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page and updating the “Last Updated” date at the top. You are advised to review this Privacy Policy periodically for any changes.
